1. Introduction
These Terms & Conditions (“Terms”) govern your access to and use of Strykflow’s website, software, AI systems, and services.
By using our services, you agree to be bound by these Terms.
2. Services
Strykflow provides:
- AI voice callers (inbound and outbound)
- Call recording, transcription, and summarisation
- CRM integrations
- Workflow automation
- Analytics and reporting
- Consulting and setup services
- Ongoing managed services under subscription agreements
3. AI Systems Disclaimer
You acknowledge and agree that:
- AI responses are automated
- AI outputs may contain errors or inaccuracies
- AI does not provide legal, financial, or property advice
- Final decisions and actions remain the responsibility of humans
- Strykflow does not guarantee business outcomes
4. Data Ownership
- Clients retain full ownership of all data generated through their use of the services.
- Strykflow acts solely as a data processor.
5. Call Recording Compliance
Clients are solely responsible for:
- Ensuring lawful consent for call recording
- Compliance with all applicable telecommunications and privacy laws
- Configuring lawful usage of AI calling services
6. Fees and Payments
- Services may be subject to setup fees and ongoing subscription fees.
- All fees are non-refundable, including setup fees and subscription payments.
- Payments are processed via third-party payment providers.
7. Suspension and Termination
We may suspend or terminate services immediately if:
- Payments are overdue
- Services are misused or abused
- Services are used for unlawful activities
- Continued use poses legal, security, or reputational risk
8. Intellectual Property
All intellectual property in the Strykflow platform, software, AI systems, and materials remains the property of Strykflow or its licensors.
You are granted a limited, non-exclusive, non-transferable licence to use the services during your subscription term.
9. Limitation of Liability
To the maximum extent permitted by law:
- Strykflow excludes all liability for indirect, consequential, or economic loss
- Strykflow is not liable for business losses, lost profits, or reputational damage
- Our total liability is limited to the fees paid in the preceding 3 months
Nothing in these Terms excludes rights under the Australian Consumer Law that cannot be excluded.
10. Indemnity
You agree to indemnify Strykflow against any claims, losses, or damages arising from:
- Your use of the services
- Breach of these Terms
- Failure to comply with applicable laws
- Misuse of AI systems
11. Confidentiality
Each party must keep confidential any non-public information obtained through the relationship, except where disclosure is required by law.
12. Changes to Services or Terms
We may modify services or these Terms at any time. Continued use after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia.The courts of NSW have exclusive jurisdiction.
